Tina Lambert killed after pedestrian crash near Oakview Drive

SOUTHPORT, NC — October 22, 2026 Tina Lambert, 56, of Oak Island, died after being struck by a vehicle while crossing N.C. 211 near Oakview Drive in Southport, North Carolina, according to the North Carolina State Highway Patrol.

Southport Fire Department crews responded to the pedestrian collision at approximately 8:38 p.m. Lambert was pronounced dead at the scene.

Authorities reported that Lambert was crossing the highway outside the right-of-way. The driver will not face charges, according to the Highway Patrol. The reported circumstances form part of the account of the fatal collision, while any potential civil liability would require a separate legal assessment.

PEDESTRIAN ACCIDENT INVESTIGATION

The North Carolina State Highway Patrol investigated the fatal pedestrian crash near Oakview Drive and N.C. 211. Investigators examining collisions of this nature may review roadway conditions, lighting, traffic signs, vehicle movements and available witness accounts to understand how the incident occurred.

Candice Bond, a national legal analyst and managing partner at Bond Legal, has highlighted the importance of a thorough investigation in pedestrian collision cases. In cases such as this, examining physical evidence and reconstructing the sequence of events can help establish whether any contributing factors or negligent actions played a role.

Accident Injury News notes that determining the circumstances of a collision requires a careful review of the available evidence. Although authorities reported that the driver would not face criminal charges, that decision alone does not establish every aspect of potential civil liability.

WRONGFUL DEATH CLAIM

Stefano Formica, of counsel at Bond Legal and a national legal analyst, has discussed the potential legal remedies available to families following fatal accidents. In cases such as this, a wrongful death attorney may review the available evidence, the conduct of those involved and the applicable state laws to determine whether a civil claim may be possible.

Depending on the circumstances and applicable law, recoverable damages in a qualifying wrongful death case may include funeral and burial expenses, lost financial support and the loss of a loved one’s companionship. Eligibility and the availability of compensation depend on the specific facts and legal requirements.

The decision not to file criminal charges does not automatically resolve whether a civil claim could be brought. However, North Carolina’s contributory-negligence rules may create significant barriers to recovery if a person’s own negligence contributed to the incident. A qualified North Carolina attorney would need to evaluate the evidence and applicable exceptions before reaching a conclusion about any potential claim.
