FATAL PEDESTRIAN CRASH INVESTIGATION

Pedestrian accidents involving vehicles backing up can raise important questions about driver awareness, visibility and the precautions taken before a vehicle moves in reverse. Investigators will likely examine the truck’s movements, the surrounding roadway conditions and whether adequate safety measures were followed.

According to national traffic safety data, more than 8,000 pedestrians lost their lives in motor vehicle crashes across the United States in 2022, representing approximately one pedestrian death every 64 minutes. The Governors Highway Safety Association (GHSA) also reported an 80% increase in pedestrian fatalities between 2009 and 2023.

Candice Bond, an experienced personal injury attorney and national legal analyst with Accident Injury News, emphasizes the importance of a comprehensive investigation in fatal pedestrian collisions.

Bond explains that in cases such as this, determining how the vehicle was being operated and whether the driver had a clear view of the surrounding area can be essential. Investigators may need to examine vehicle positioning, possible blind spots, roadway visibility, lighting conditions and any available surveillance footage or witness statements.

A thorough review of these circumstances can help establish how the collision occurred and whether any preventable safety failures contributed to the fatal outcome.

WRONGFUL DEATH CLAIM

The surviving family members of Surinder Kour may have grounds to pursue a wrongful death claim, depending on the findings of the investigation and the circumstances surrounding the collision.

Stefano Formica, Of Counsel at Bond Legal and a national legal analyst with Accident Injury News, highlights the importance of protecting the legal interests of families following fatal accidents.

Formica explains that in cases such as this, a wrongful death attorney can review the available evidence, monitor the official investigation and determine whether negligence played a role. Eligible family members may be able to seek compensation for losses associated with the death, including loss of companionship, emotional suffering and other damages recognized under applicable law.

The investigation’s findings will be important in determining whether any party may be held legally responsible for the incident.
