Nancy Harvey killed in Las Cruces BNSF train accident, according to police

LAS CRUCES, NM — October 13, 2026 A 9-year-old girl was fatally struck by a BNSF train early Tuesday near the intersection of South Main Street and Conway Avenue.

Nancy Harvey was found deceased on the railroad tracks around 2 a.m. after her family reported her missing a short time earlier. Las Cruces police and firefighters responded to the scene. Authorities said she had wandered from a residence in the 200 block of Conway Avenue. The southbound BNSF train came to a stop following the collision. The incident remains under active investigation by local police.

FATAL PEDESTRIAN ACCIDENT INVESTIGATION

Railroad crossing and pedestrian incidents can stem from multiple factors, including human error by train crew, track or signal problems, mechanical issues, or conditions that leave an area insufficiently protected for people on foot. Federal data from the National Transportation Safety Board indicate roughly 1,000 fatalities occur in train-related events across the United States each year.

In cases such as this, national legal analysts stress the importance of a prompt, independent review. Candice Bond, Managing Partner at Bond Legal and a train-accident specialist, has noted that families benefit when experienced counsel steps in quickly to secure evidence before it is altered or lost. “A skilled attorney can protect a grieving family from train companies, which often send their investigators to crash sites and possess a variety of resources they can utilize to defend themselves,” Bond has said. She emphasizes that an independent investigator can examine whether the location had adequate fencing, lighting, warning devices, or other pedestrian safeguards, and can document the scene while memories and physical traces remain fresh.

WRONGFUL DEATH CLAIM

Surviving relatives of a child killed in a railroad collision may pursue a wrongful-death action. Such claims commonly seek compensation for the loss of a child’s companionship, the pain and suffering experienced, and the emotional distress that follows a sudden, catastrophic event.

Stefano Formica, Of Counsel with Bond Legal, has observed that “we understand just what families are forced to go through, and having their rights protected is vital.” In cases such as this, Formica explains, a wrongful-death attorney monitors the official probe, gathers records, and works to ensure the family’s interests are fully represented. Relatives are entitled to pursue damages that reflect both the tangible and intangible losses that arise after a preventable tragedy.

Accident Injury News extends sympathy to Nancy Harvey’s family and all those affected by this loss. Further details will be reported as the investigation continues.
