Mario Montes killed in Jal crash, according to Lea County Sheriff

JAL, NM — October 15, 2026 Mario Montes, 46, died in a collision involving two semitrucks at the intersection of New Mexico Highway 128 and Orla Road near Jal, according to the Lea County Sheriff’s Office.

The crash occurred at approximately 1:30 a.m. Thursday. Deputies responding to the scene around 1:47 a.m. discovered two commercial trucks engulfed in flames on the north side of the intersection.

According to preliminary findings, a semitruck driven by 34-year-old Luis Diaz Mederos was traveling north on Orla Road when it failed to stop at a stop sign and collided with Montes’ westbound truck on Highway 128.

Both vehicles left the roadway and entered a roadside ditch. Montes’ truck was carrying flammable materials, and a fire followed the collision. The Jal Fire Department extinguished the blaze, and both drivers were confirmed dead.

Authorities have not released a final determination of the cause of the crash. The investigation remains ongoing.

FATAL SEMI-TRUCK ACCIDENT INVESTIGATION

Commercial truck collisions can involve several potential contributing factors, including driver actions, vehicle condition, roadway circumstances and visibility. Investigators will need to establish the complete sequence of events before reaching final conclusions about responsibility.

Candice Bond, Managing Partner of Bond Legal and a national legal analyst, has emphasized the importance of timely, independent investigations in serious truck accidents. In cases such as this, a thorough review may include examining vehicle damage, available witness accounts, driver records and relevant trucking documentation.

Investigators may also review applicable insurance policies and other evidence to clarify the circumstances surrounding the collision. Any conclusions about negligence or contributing factors should be based on verified findings rather than preliminary information alone.

WRONGFUL DEATH CLAIM

Depending on the investigation’s findings and applicable law, the families of the deceased drivers may have grounds to explore wrongful death claims.

Stefano Formica, Of Counsel with Bond Legal and a national legal analyst, has discussed the importance of protecting families’ interests following fatal accidents. In cases such as this, a review of the available evidence may help establish whether a legally responsible party can be identified.

Potential damages in an eligible wrongful death claim may include funeral expenses, loss of financial support, loss of companionship and other legally recoverable losses. Eligibility and the types of damages available depend on the facts, applicable law and the circumstances of the surviving family members.

The investigation into the fatal collision near Jal remains ongoing.
