PEDESTRIAN ACCIDENT INVESTIGATION

The Ankeny Police Department is continuing to investigate the circumstances that led to the fatal pedestrian collision. Investigators will likely examine the driver’s actions, roadway conditions, visibility, traffic patterns and other available evidence to establish how the incident occurred.

Pedestrian accidents frequently involve complex questions about driver awareness, right-of-way and roadway safety. According to the Governors Highway Safety Association, an estimated 7,148 pedestrians lost their lives in traffic crashes across the United States in 2024, including 32 fatalities in Iowa.

Candice Bond, Managing Partner at Bond Legal and a national legal analyst for Accident Injury News, emphasizes the importance of a comprehensive investigation in fatal pedestrian cases. In cases such as this, determining whether a driver failed to recognize a pedestrian, respond appropriately or yield when required can be essential to understanding how the collision happened.

Bond also highlights the importance of examining environmental and roadway factors. Investigators may need to evaluate lighting conditions, visibility, road design and the positioning of vehicles and pedestrians. Witness statements, available surveillance footage and physical evidence can also help reconstruct the events leading up to a collision.

WRONGFUL DEATH CLAIM

The family of Jade Stewart may have grounds to pursue a wrongful death claim depending on the findings of the investigation and whether negligence contributed to the fatal accident.

Stefano Formica, Of Counsel at Bond Legal and a national legal analyst for Accident Injury News, explains that families who lose someone in a preventable traffic accident may have legal options available to them. Depending on the circumstances and applicable Iowa law, recoverable damages may include funeral and burial expenses, lost financial support, loss of companionship and other legally recognized losses.

In cases such as this, establishing liability requires a careful review of the available evidence and the circumstances surrounding the collision. Formica also stresses the importance of protecting a family’s interests when dealing with insurance companies, particularly when settlement offers are presented before the full extent of the family’s losses has been evaluated.

An experienced wrongful death attorney can help families understand their legal rights, assess potential compensation and navigate the claims process during an exceptionally difficult period.
