Claudia Luna Hurt in Suspected DWI Crash on Fort Worth I-35

FORT WORTH, TX — October 25, 2026 Claudia Luna was seriously injured Sunday after a suspected impaired driver allegedly struck her SUV from behind on Interstate 35 in Fort Worth, Texas.

According to police, Luna was traveling southbound on I-35 near Altamesa Boulevard when a vehicle operated by 34-year-old Gustavo Diaz allegedly hit her SUV from the rear. The impact caused Luna’s vehicle to overturn, leaving her and a passenger in need of medical treatment at a nearby hospital.

Authorities reported that Diaz attempted to leave the scene following the collision but was apprehended shortly afterward. Investigators also stated that this was reportedly his second driving while intoxicated (DWI) incident within one week.

Diaz faces two counts of intoxication assault and a charge related to a collision involving serious bodily injury, according to the report. The investigation is expected to establish further details about the circumstances surrounding the crash.

DWI CRASH INVESTIGATION

Driving while impaired can put motorists, passengers, and other road users at significant risk. Alcohol and other intoxicating substances can interfere with judgment, reduce coordination, impair vision, and slow a driver’s ability to react to changing traffic conditions.

In cases such as this, investigators may review crash-scene evidence, vehicle damage, witness accounts, available surveillance footage, and relevant toxicology results to determine how the collision occurred and whether impairment contributed to it. The findings may also help establish responsibility for the resulting injuries.

Candice Bond, Managing Partner of Bond Legal and a national legal analyst, has highlighted the importance of protecting injured victims’ rights in collisions involving suspected impaired driving. From a general legal perspective, an independent review can help preserve important evidence and identify potentially responsible parties. Relevant records may include witness statements, video footage, and available phone records.

A thorough investigation can also help clarify the distinction between criminal proceedings and a potential civil claim. Although authorities determine whether criminal charges are warranted, injured individuals may separately explore their legal options for recovering accident-related losses.

PERSONAL INJURY CLAIM

Claudia Luna may be eligible to pursue a personal injury claim, depending on the investigation’s findings and the available evidence. Potential damages in a qualifying case may include emergency treatment, continuing medical expenses, rehabilitation, lost income, pain and suffering, and emotional distress.

Stefano Formica, Of Counsel with Bond Legal and a national legal analyst, has emphasized the importance of understanding an injured person’s legal rights after a serious collision. In cases such as this, the financial consequences may extend beyond the initial hospital visit, particularly when treatment or recovery affects a person’s ability to work and manage everyday responsibilities.

A personal injury attorney can help assess the available evidence, communicate with insurance companies, document financial losses, and explain potential avenues for compensation. Any recovery would depend on the facts established, applicable Texas law, and the outcome of the claim.

The investigation into the Fort Worth collision remains important to determining the circumstances of the crash and any resulting legal responsibility.
