Adinaluz Prieto Oyola killed in Winter Haven school bus crash

WINTER HAVEN, FL — October 5, 2026 A deadly chain-reaction collision along Lucerne Park Road in Winter Haven claimed the lives of a 16-year-old high school student and a Jeep driver Monday morning, while dozens of others were transported for medical treatment.

The student was identified as Adinaluz Guadalupe Prieto Oyola, a 10th-grade student at Winter Haven High School who was traveling aboard a Polk County school bus when the crash occurred.

According to the Polk County Sheriff’s Office, the collision happened at approximately 6:12 a.m. as a white Chevrolet Malibu was traveling westbound on Lucerne Park Road, also known as State Road 544. A school bus carrying students was traveling eastbound toward Winter Haven High School.

Investigators said the Malibu crossed the centerline and struck the rear tandem-wheel section of the school bus. The impact damaged the bus and caused it to move into the westbound lanes, where it collided head-on with a silver Jeep.

The school bus subsequently overturned and came to rest in a roadside ditch. A fourth vehicle later struck the Malibu.

Oyola was pronounced dead at the crash scene. The driver of the Jeep, identified as a 26-year-old man commuting to work, also died.

The school bus was carrying 39 people, including 37 students, the bus driver and the driver’s 9-year-old daughter. Multiple students were taken to area hospitals, including three who were airlifted, seven transported by ambulance and 22 moved aboard another school bus with medical assistance.

Authorities later reported that three students remained hospitalized but were expected to recover. The crash prompted a response from the National Transportation Safety Board as investigators continued examining the circumstances surrounding the collision.

CRASH INVESTIGATION

The Polk County Sheriff’s Office continues to examine why the Chevrolet Malibu crossed the centerline before striking the school bus. Investigators identified the Malibu driver as a 23-year-old nursing student who was traveling to work at the time of the crash.

Authorities said the driver has cooperated with the investigation. Investigators reviewed phone information and conducted voluntary testing as part of the effort to determine whether impairment, distracted driving or another factor contributed to the collision.

According to investigators, there was no indication that speeding, alcohol impairment or cellphone use caused the crash. The driver reportedly told investigators that she did not remember what happened immediately before the collision. Authorities indicated that criminal charges were not expected, although traffic citations and possible civil consequences remained considerations.

National legal analyst Candice Bond, a managing partner with Bond Legal, has emphasized that determining the precise cause of a serious crash is an important part of protecting the interests of affected families.

In cases such as this, Bond’s analysis suggests that an investigation should go beyond the initial police account. Evidence such as vehicle damage, roadway conditions, witness accounts, available video, driver history, insurance coverage and other crash-related records may help establish how the collision occurred and whether additional factors contributed.

An independent legal review can also be important when multiple vehicles and injured parties are involved. In a complex chain-reaction collision, investigators may need to establish the sequence of impacts and determine how each vehicle’s movement contributed to the final outcome.

Bond has noted that legal professionals can also assist families by identifying relevant witnesses, obtaining available records, consulting accident-reconstruction specialists and examining applicable insurance policies. These steps can become particularly important when an investigation involves fatalities as well as numerous injured passengers.

WRONGFUL DEATH CLAIM

Following a fatal accident, surviving family members may have the right to explore a wrongful death claim depending on the findings of the investigation and applicable Florida law.

Such a claim may seek compensation for losses associated with the death of a loved one. Depending on the circumstances and the applicable legal requirements, potential damages can include loss of companionship, emotional suffering and other economic or noneconomic losses connected with the death.

National legal analyst Stefano Formica, Of Counsel at Bond Legal, has stressed that the period following a fatal collision can be particularly difficult for surviving relatives. In cases such as this, families may face both the emotional impact of a sudden death and the practical challenges that follow a major accident.

Formica’s legal analysis indicates that families considering a wrongful death claim should monitor the official investigation and understand how its findings could affect potential legal options. Evidence gathered by law enforcement, accident investigators and other experts may become relevant when determining liability.

Because this crash involved a school bus, multiple vehicles and numerous injured passengers, the circumstances surrounding the initial collision and the subsequent impacts may be important in evaluating any potential civil claim.
