GASTON, SC, (April 14, 2026) – A 49-year-old man was killed early Tuesday in a pedestrian crash on Highway 321 in Lexington County.

According to the Lexington County Coroner’s Office, Mark Bartholomew Mack was walking along the roadway near Wilbur Road at approximately 1:10 a.m. when he was struck by a southbound 2011 Toyota Sienna. Authorities said Mack was reportedly walking north in the southbound lanes at the time of the collision.

Mack was pronounced dead at the scene. The driver remained with the victim until emergency responders arrived and was later taken to a nearby medical facility for evaluation.

The South Carolina Highway Patrol, along with the coroner’s office, continues to investigate the incident.

PEDESTRIAN ACCIDENT INVESTIGATION

Each year, pedestrian fatalities continue to rise across U.S. roadways, many of which are preventable with increased driver awareness. In the first half of 2024 alone, approximately 3,304 pedestrians were killed, according to the Governors Highway Safety Association.

“Having the proper resources is critical when investigating pedestrian accident cases and establishing negligence,” said Candice Bond, Managing Partner of Bond Legal and an experienced pedestrian accident attorney.

“Factors such as roadway conditions, visibility of signage, and lighting must all be thoroughly reviewed,” Bond explained. “These elements play a key role in helping families seek justice after a tragic loss.”

She added that accident reconstruction specialists are sometimes necessary to determine the sequence of events. “These resources are essential for helping victims or their families pursue compensation following a collision,” said Bond, a national legal analyst for Accident Injury News.

WRONGFUL DEATH CLAIM

“It is generally the responsibility of drivers to yield to pedestrians,” said Stefano Formica, Of Counsel at Bond Legal. The family of the victim may have the right to pursue a wrongful death claim.

“Relatives of wrongful death victims may seek compensation for loss of income, companionship, pain and suffering, funeral expenses, and emotional distress following a tragic accident,” Formica said.

An attorney can act as an advocate, guiding families through the legal process while ensuring their rights are protected during this difficult time.

“Insurance companies often attempt to pressure families into accepting quick settlements that may not reflect the true value of the case,” Formica added. “However, legal representation helps ensure that victims’ families are treated fairly and receive appropriate compensation.”
