Florence PD: Mary Ann Westfall dies after parking lot crash

FLORENCE, AL, (March 24, 2026) – Mary Ann Westfall, 85, was fatally injured after being struck by a vehicle while walking near a shopping center in Florence, authorities said. The incident occurred in the 1700 block of Darby Drive, just feet from a marked crosswalk near Ollie’s. Westfall was transported to Huntsville Hospital, where she later succumbed to her injuries nearly two weeks after the crash.

Witnesses reported that the vehicle appeared to be traveling too fast for a parking lot and did not slow immediately after impact. The Florence Police Department continues to investigate.

PEDESTRIAN ACCIDENT INVESTIGATION

Each year, pedestrian fatalities continue to rise across the United States, many of which are preventable when drivers remain attentive. According to the Governors Highway Safety Association, about 3,304 pedestrians were killed in the first half of 2024.

“Having the proper resources is essential when investigating a pedestrian accident and establishing negligence,” said Candice Bond, Managing Partner of Bond Legal and an experienced pedestrian accident attorney.

“Factors such as road conditions, visibility of signage, and lighting must all be carefully reviewed as they may contribute to a crash. A thorough evaluation is critical in helping families seek the justice they deserve,” Bond added.

“In some cases, an accident reconstruction team is required to determine exactly what occurred. These resources play a key role in helping clients pursue compensation for damages or losses,” said Bond, a national legal analyst for Accident Injury News.

WRONGFUL DEATH CLAIM

“It is almost always a driver’s responsibility to yield to pedestrians,” said Stefano Formica, of counsel at Bond Legal. The family of Mary Ann Westfall may be eligible to pursue a wrongful death claim.

“Families who lose a loved one in a wrongful death case may seek compensation for loss of income, companionship, pain and suffering, funeral costs, and emotional distress,” Formica stated.

An attorney can serve as an advocate, helping guide families through a difficult time while ensuring their rights are protected.

“Insurance companies often attempt to pressure victims into accepting quick settlements that are far below what a case may be worth,” Formica added. “An attorney will strongly advocate to ensure fair treatment and proper compensation.”
