LAKE WALES, FL (October 30, 2026) — A 60-year-old man from Auburndale lost his life Friday morning after being struck by a Chevrolet pickup truck while outside his work vehicle on 1st Street in Lake Wales, Polk County.

According to the Lake Wales Police Department, Gary Dewayne Mitchell was operating a Republic Services garbage truck at approximately 6:11 a.m. when he stopped along 1st Street. He exited the truck to signal another motorist traveling behind him to pass.

As Mitchell stood outside the vehicle, a northbound Chevrolet 3500 pickup truck driven by a Lake Wales man struck him.

Emergency responders transported Mitchell to AdventHealth Lake Wales for medical treatment. However, he later succumbed to his injuries at the hospital.

The circumstances surrounding the collision remain under investigation.

Incident Location

FATAL PEDESTRIAN ACCIDENT INVESTIGATION

Police are continuing to investigate the circumstances that led to the fatal collision. The initial findings indicate that Mitchell was outside his Republic Services truck when he was struck by the northbound Chevrolet pickup.

Investigators may examine the vehicle’s movements, the driver’s actions, road conditions, visibility, lighting and other factors that could have contributed to the incident. Authorities have indicated that the information released so far is preliminary, and further details may emerge as the investigation progresses.

National pedestrian safety statistics also highlight the risks faced by people walking or working near moving traffic. According to the National Safety Council, pedestrian fatalities have remained a significant road safety concern across the country.

Florida recorded 10,013 pedestrian-related crashes and 765 pedestrian deaths in 2022, according to the Florida Department of Highway Safety and Motor Vehicles.

Candice Bond, an experienced pedestrian accident attorney and Managing Partner at Bond Legal, has emphasized the importance of a comprehensive investigation in cases involving pedestrian fatalities. She has noted that examining roadway conditions, lighting, traffic signs and visibility can help investigators establish how an accident occurred and determine whether negligence played a role.

In cases such as this, national legal analysts explain that reviewing physical evidence, vehicle positioning and available witness accounts can be important in understanding the sequence of events. Accident Injury News recognizes the importance of a thorough investigation in identifying the circumstances surrounding fatal pedestrian collisions.

WRONGFUL DEATH CLAIM

The family of Gary Dewayne Mitchell may have grounds to pursue a wrongful death claim, depending on the findings of the investigation and the available evidence.

Stefano Formica, Of Counsel at Bond Legal and a national legal analyst, has explained that drivers generally have a responsibility to exercise caution around pedestrians and yield when required. In cases such as this, determining whether a driver failed to observe a pedestrian or respond appropriately to surrounding conditions may be relevant when evaluating potential liability.

Formica has also discussed the types of damages that surviving family members may be able to pursue in wrongful death cases. Depending on the circumstances and applicable law, these may include funeral and burial expenses, lost financial support, loss of companionship and emotional suffering.

Candice Bond has further highlighted the importance of protecting families’ interests when dealing with insurance companies after fatal accidents. Insurance providers may attempt to resolve claims through early settlement offers, making a careful assessment of the available evidence and potential damages particularly important.

Accident Injury News emphasizes that every wrongful death case depends on its individual facts, evidence and applicable state laws.
