Jimmy Lee Brooks killed in Buncombe County DWI crash, NCSHP says

BUNCOMBE, NC — October 22, 2026 Jimmy Lee Brooks, a resident of Leicester, North Carolina, died after a suspected impaired driver traveling in the wrong direction struck the Honda SUV in which he was riding on Interstate 26 in Buncombe County.

According to the North Carolina State Highway Patrol (NCSHP), the collision occurred at approximately 2:30 p.m. in the eastbound lanes near Exit 37. Investigators reported that a Tesla allegedly driven by Bradley Lanier was traveling westbound against traffic when it collided head-on with the Honda.

Brooks was transported to Mission Hospital, where he was pronounced dead. The Honda’s driver and another passenger sustained serious injuries and were also taken to the hospital.

Authorities are investigating the circumstances surrounding the fatal collision. The initial report identifies Lanier as the driver of the Tesla but contains an apparent inconsistency in its description of the charges. The precise charges against the driver should be confirmed through official records.

FATAL DWI CRASH INVESTIGATION

North Carolina recorded 361 deaths and 7,227 injuries in crashes involving alcohol-impaired drivers during 2024, according to the state Department of Transportation.

Alcohol can affect a driver’s judgment, coordination, vision and reaction time, increasing the likelihood of dangerous driving decisions. Traveling against the flow of traffic can create an especially serious risk because approaching motorists may have little time to avoid a collision.

In cases such as this, national legal analyst Candice Bond, an experienced DUI accident attorney and Managing Partner of Bond Legal, has emphasized the importance of a thorough investigation. Relevant evidence may include witness statements, available surveillance footage, vehicle damage, crash-scene measurements and phone records. Investigators may also examine evidence related to suspected impairment and the vehicle’s movements before impact.

Establishing the sequence of events and determining whether negligence contributed to the collision can help clarify responsibility. Criminal proceedings and any potential civil case are separate matters, and liability must be evaluated using the available evidence.

WRONGFUL DEATH CLAIM

Following a fatal collision, eligible family members may have grounds to pursue a wrongful death claim if evidence establishes that another party’s negligence caused the death. Depending on the circumstances and applicable North Carolina law, recoverable damages may include funeral expenses, medical costs associated with the final injury, loss of the deceased’s services and companionship, and other legally recognized losses.

National legal analyst Stefano Formica, Of Counsel with Bond Legal, has highlighted the importance of protecting families’ rights following a fatal accident. In cases such as this, a wrongful death attorney may review investigative findings, explain the available legal options and help eligible relatives understand the claims process.

Any civil claim would depend on the evidence, the parties’ respective responsibilities and the requirements of state law. A potential claim does not establish fault by itself, and the outcome of any legal action remains uncertain.
