Vernell Hayes Faces Two Felony DUI Charges After Tega Cay Crash

TEGA CAY, SC, (October 17, 2026) Gabriel Tucker Williams, 26, of Fort Mill, died after a motorcycle collided with a passenger vehicle at the intersection of West Highway 160 and Tillberg Way in Tega Cay. His passenger, Aeryn Kira Sutherland, 31, of Charlotte, North Carolina, also died following the early-morning crash, according to authorities.

The collision occurred shortly after midnight on Saturday, October 17, according to the Tega Cay Police Department. Preliminary reports indicate that Williams was traveling northbound on Highway 160 when a southbound vehicle attempted to turn left onto Tillberg Way and struck the motorcycle.

Williams suffered fatal injuries and was pronounced dead at the scene. Sutherland sustained critical injuries and was transported to Piedmont Medical Center in Rock Hill, where she later died.

Vernell Laurthel Hayes, 45, of Fort Mill, was arrested in connection with the collision and faces two counts of felony driving under the influence (DUI) resulting in death. According to arrest warrants cited in local reporting, Hayes acknowledged consuming alcohol before the crash, and a breath test reportedly showed a blood alcohol concentration of 0.13, above South Carolina’s legal limit of 0.08.

Hayes remains in custody at the York County Detention Center without bond, according to local reports.

The York County Coroner’s Office reported that pathology and toxicology results for the victims were pending. The Tega Cay Police Department and the South Carolina Highway Patrol are investigating the circumstances surrounding the collision.

DUI ACCIDENT INVESTIGATION

Authorities are examining the events leading up to the collision at West Highway 160 and Tillberg Way, including the reported left turn and the motorcycle’s direction of travel. Investigators may review physical evidence, vehicle damage, witness accounts and any available surveillance footage to establish how the crash occurred.

Candice Bond, a national legal analyst and managing partner at Bond Legal, has discussed the importance of thorough investigations in motorcycle collision cases. In cases such as this, examining the sequence of events, right-of-way decisions and potential impairment can help investigators develop a clearer understanding of the factors involved. Independent accident reconstruction may also help clarify vehicle movements and the point of impact.

The reported alcohol test and allegations concerning the driver’s conduct remain important elements of the investigation. Authorities have not announced final findings, and the case remains under investigation by the Tega Cay Police Department and the South Carolina Highway Patrol.

WRONGFUL DEATH CLAIM

The families of Williams and Sutherland may have grounds to explore wrongful death claims, depending on the findings of the investigation and the evidence establishing liability. Such civil claims can potentially address eligible losses, including funeral expenses, financial support and loss of companionship, subject to applicable South Carolina law.

Stefano Formica, of counsel at Bond Legal and a national legal analyst, has highlighted the importance of protecting families’ legal rights after fatal collisions. In cases such as this, a careful review of the crash evidence, insurance coverage and documented losses can help establish whether a civil claim may be available.

Any potential civil claim would be separate from the criminal proceedings against Hayes. The outcome of a civil case would depend on the evidence, applicable law and the circumstances established through the investigation.
