Vivian Kuntz dies in Route 42 pedestrian wreck in Douglas Co OR

GREEN, OR, (April 25, 2026) – A 40-year-old Eugene woman lost her life Saturday night after being struck by a vehicle in a pedestrian crash along Oregon Route 42 in Douglas County.

According to the Oregon State Patrol, Vivian Kuntz was hit by a westbound Ford Focus driven by a 38-year-old man from Roseburg. The collision occurred at approximately 10:59 p.m. near milepost 76 in the community of Green.

Authorities said Kuntz was crossing the roadway from Grant Smith Road toward Route 99 when the vehicle struck her.

Emergency responders arrived at the scene, but Kuntz was pronounced dead due to injuries sustained in the crash.

The incident remains under investigation by the Oregon State Patrol.

FATAL PEDESTRIAN ACCIDENT INVESTIGATION

Although drivers are typically required to yield to pedestrians, individuals on foot continue to face serious risks on roadways across the country. The Governors Highway Safety Association estimates there were 6,721 pedestrian fatalities in 2020, marking a 4.8% increase from 6,412 deaths in 2019.

“In most cases, pedestrians have the right of way when crossing a street or intersection, even if they are not within a marked crosswalk,” said Candice Bond, a seasoned pedestrian accident attorney.

Bond, Managing Partner at Bond Legal, emphasized that in incidents like this, it is crucial for families to seek an independent investigation by an experienced attorney to help safeguard their rights.

“Access to the right resources is essential when examining a pedestrian accident to establish negligence,” Bond added. “Factors such as road conditions, visibility of signage, and lighting must all be carefully reviewed. These steps are vital in helping families pursue justice after the loss of a loved one.”

WRONGFUL DEATH CLAIM

Pending the findings of the investigation, the family of Vivian Kuntz may have the right to pursue a wrongful death claim for the loss of companionship, funeral expenses, pain and suffering, and emotional distress.

“The grief and emotional burden following such a loss can be overwhelming,” said Stefano Formica, Of Counsel with Bond Legal. “We understand the challenges families face during these times, and ensuring their rights are protected is essential. A wrongful death attorney can monitor the progress of the investigation and help protect the family’s legal interests.”
