Tommy Heaton seriously hurt in Cobb County DUI accident

COBB, GA (April 14, 2026) – A suspected DUI crash Tuesday night in Cobb County left two people seriously injured, including a passenger identified as Tommy Heaton, police said.

According to the Cobb County Police Department, a 2020 Chevrolet Trax was traveling southbound on Cumberland Parkway near Mt. Wilkinson Parkway at approximately 10:43 p.m. when the driver attempted a left turn and crossed into the path of a northbound Mercedes-Benz.

The collision resulted in serious injuries to Heaton, 35, who was a passenger in the Chevrolet. He was transported to Wellstar Kennestone Hospital for emergency treatment.

A passenger in the Mercedes also sustained serious injuries, while the driver and another occupant of that vehicle suffered minor injuries. Authorities said the driver of the Chevrolet was arrested and faces charges including DUI, failure to yield, and felony serious injury by vehicle.

The crash remains under investigation.

DUI ACCIDENT INVESTIGATION

This accident was clearly preventable. Impaired drivers pose a danger to everyone on the roadway and can cause devastating consequences.

“Drunken and drugged drivers are subject to criminal charges following an accident or collision that causes harm or kills another person,” explained Candice Bond, a Managing Partner at Bond Legal.

“Beyond criminal charges, victims or their families may also pursue compensation through a civil lawsuit against the responsible party,” added Bond, an experienced DUI accident attorney.

According to the National Safety Council, approximately 10 percent of all fatal automobile accidents are caused by drivers under the influence of alcohol, drugs, or medications. These crashes remain the second-leading cause of roadway fatalities in the United States.

PERSONAL INJURY CLAIM

Tommy Heaton may have the right to pursue a personal injury claim pending an investigation.

Stefano Formica, of counsel at Bond Legal, said, “Injured victims involved in a collision often pursue a personal injury claim to cover medical expenses, future care, lost income, emotional trauma, and pain and suffering.”

“Insurance companies are often indifferent to the growing financial burden faced by injured victims. An attorney can help by advocating on their behalf and ensuring they are fairly compensated,” he added.
