Police: Thomas Diguette fatally hit on Palm Canyon Drive CA

PALM SPRINGS, CA, (April 29, 2026) – A 78-year-old man died after being struck by a vehicle Wednesday night at an intersection in Palm Springs, authorities said.

The victim was identified as Thomas Diguette, a resident of Palm Springs.

According to preliminary reports, the crash occurred at the intersection of East Palm Canyon Drive and Cherokee Way shortly after 8 p.m. A vehicle traveling eastbound on East Palm Canyon Drive struck Diguette as he was in the east crosswalk.

Diguette was transported to a hospital, where he later died from his injuries.

Police said the driver remained at the scene. No additional details were immediately released as the investigation continues.

CRASH INVESTIGATION NEEDED

A vulnerable road user—such as a pedestrian or runner—faces significant risk when sharing the road with motor vehicles. For this reason, drivers must remain vigilant and always yield the right-of-way to pedestrians. Over the past decade, pedestrian fatalities have increased at a rate nearly seven times higher than U.S. population growth (7%), according to the Governors Highway Safety Association (GHSA).

“In most cases, pedestrians have the right of way when crossing a street or intersection, whether or not the crosswalk is marked,” said Candice Bond, an experienced pedestrian accident attorney.

Bond, Managing Partner of Bond Legal, emphasized the importance of an independent investigation conducted by an experienced attorney to safeguard the rights of the victim’s family in incidents like this.

In cases of this nature, timing is critical. Promptly preserving and reviewing evidence can play a key role in determining exactly what happened.

WRONGFUL DEATH CLAIM

“It is generally the responsibility of drivers to yield to pedestrians,” said Stefano Formica, of counsel at Bond Legal. The family of Thomas Diguette may have the right to pursue a wrongful death claim.

“Families who lose a loved one in such incidents may seek compensation for loss of companionship and income, emotional suffering, funeral costs, and other damages,” Formica said. An attorney can provide guidance and support during this difficult time while ensuring that the family’s rights are protected.

“Insurance companies may attempt to push for quick settlements that do not reflect the true value of a claim,” Formica added. “An attorney will advocate strongly to ensure fair treatment and proper compensation.”
