FATAL PEDESTRIAN CRASH INVESTIGATION NEEDED

Regardless of fault, when a vehicle collides with a pedestrian, the pedestrian is at far greater risk of serious injury or death. While all road users must follow safety rules, drivers bear a significant responsibility to remain alert.

Drivers struck and killed an estimated 7,508 pedestrians in 2022, marking the highest number in four decades, according to the Governors Highway Safety Association (GHSA).

Candice Bond, an experienced pedestrian accident attorney, noted that crashes like this can occur due to various factors, including inexperience, failure to follow traffic laws, reckless driving, unfamiliar roads, or impairment.

“Every case is different and requires a detailed investigation. Acting quickly is crucial so that evidence can be properly preserved and reviewed,” said Bond, Managing Partner at Bond Legal. “An attorney has the ability to consult expert witnesses, conduct background checks, and examine insurance coverage. These steps are essential in helping families pursue justice and compensation.”

“An accident reconstruction team may also be needed to determine exactly what occurred. These resources are important in helping clients recover damages following a collision,” said Bond, a national analyst for Accident Injury News.

WRONGFUL DEATH CLAIM

Pending the results of the investigation, the family of Sergio Morales may be eligible to pursue a wrongful death claim. Families of victims may seek compensation for loss of companionship, pain and suffering, and emotional distress following such a tragic incident.

“In many situations, pedestrians have the right of way when crossing a street, whether or not it is a marked crosswalk. Drivers have a duty to yield,” said Stefano Formica, of counsel at Bond Legal.

“It is essential to determine the exact cause of these accidents. An attorney has the resources to review insurance coverage, hire expert witnesses, conduct background checks, and locate witnesses. We help guide families through this process,” Formica said.

“The loss of a loved one in an accident is devastating for a family. Beyond emotional grief, there can also be serious financial consequences, including loss of income and funeral expenses,” Formica added.
