Scott Berberian dies in Stafford DUI crash on I-90 NY, driver held

STAFFORD, NY, (April 09, 2026) — A 56-year-old man was killed Thursday night in a crash in Stafford, while another driver was arrested on suspicion of driving while intoxicated, authorities said.

According to New York State Police, a 2024 BMW X6 traveling eastbound near mile marker 384 struck a 2017 GMC pickup truck from behind at approximately 8:53 p.m. The impact caused the pickup to overturn, ejecting its driver.

The victim, identified as Scott K. Berberian of Syracuse, was pronounced dead at the scene. The driver of the BMW failed field sobriety tests and recorded a blood alcohol concentration of 0.08%, leading to his arrest on multiple charges, including a felony DWI.

CRASH INVESTIGATION NEEDED

Those with information are urged to contact New York State Police at 585-344-6200.

Drunk driving continues to result in preventable fatalities across the United States despite awareness efforts and strict laws. In 2023, one person died every 42 minutes in a drunk-driving crash, according to the National Highway Traffic Safety Administration.

An independent investigation may be necessary to determine additional contributing factors, including the results of blood-alcohol testing conducted on the driver.

“Drunken and drug-impaired drivers face criminal charges when their actions lead to injury or death,” said Candice Bond, Managing Partner at Bond Legal. “Beyond criminal proceedings, a victim’s family may also pursue compensation through a civil lawsuit against the responsible party.”

“Serving as an advocate, an attorney can help guide victims’ families through this difficult time while protecting their rights and ensuring accountability,” added Bond, an experienced DUI accident attorney.

WRONGFUL DEATH CLAIM

Pending the outcome of the investigation, the family of Scott K. Berberian may be entitled to pursue a wrongful death claim for damages including medical and funeral costs, loss of companionship, and emotional suffering.

“A wrongful death occurs when a negligent or reckless act results in loss of life,” said Stefano Formica, of Counsel with Bond Legal.

“In cases where fatal crashes are caused by unsafe driving behaviors such as impairment, speeding, or distraction, surviving family members often have the right to pursue a civil action against the responsible party.”
