San Jose alleged DUI crash claims life of Jerome Castro, police say

SAN JOSE, CA — A 39-year-old Calaveras County man died Wednesday afternoon in a suspected drunk driving collision on Monterey Road, according to San Jose police.

The Santa Clara County Medical Examiner-Coroner’s Office has identified the victim as Jerome Michael Castro.

Preliminary investigation indicates that a woman driving a silver 2007 Ford sedan was traveling west on Rancho Drive around 5:35 p.m. when she turned left onto southbound Monterey Road, entering the path of a northbound blue 2013 BMW coupe. The impact caused the BMW to strike the center divider and cross into southbound lanes.

Castro, a passenger in the BMW, succumbed to his injuries at the scene. Both drivers were transported to area hospitals for treatment.

Police report that the Ford driver was allegedly operating her vehicle under the influence of alcohol at the time of the crash. The investigation remains active.

CRASH INVESTIGATION NEEDED

Even when drivers believe they are not impaired, alcohol or drugs can significantly impair coordination. Driving under the influence dramatically increases the risk of accidents that may cause fatal or life-altering injuries. According to the National Highway Traffic Safety Administration (NHTSA), approximately 10,850 people died annually in alcohol-related crashes between 2012 and 2021.

An independent investigation is essential to identify additional contributing factors, including blood-alcohol content test results from the driver involved.

“Drivers impaired by alcohol or drugs face criminal prosecution when their actions result in accidents causing injury or death,” explained Candice Bond, Managing Partner at Bond Legal. “Separate from criminal proceedings, victims’ families may be eligible for compensation through civil claims against responsible parties,” said Bond.

“While serving as an advocate, an attorney can compassionately guide victims through this challenging time, protecting their legal rights while ensuring impaired drivers are held accountable for their reckless behavior,” added Bond, an experienced DUI accident attorney.

WRONGFUL DEATH CLAIM

Pending the investigation’s outcome, the family of Jerome Michael Castro may have grounds to pursue a wrongful death claim for medical and funeral expenses, loss of love and companionship, pain and suffering, and emotional trauma.

“An incident is considered a wrongful death when either a person or entity commits a wrongful or negligent act resulting in a person’s death,” said Candice Bond, Managing Partner of Bond Legal.

“When vehicle accident fatalities result from unsafe driving, aggressive or distracted driving, speeding, or driving under the influence, family members are usually left with the option to pursue a civil action against the responsible motorist.”
