Pedestrian Gorzynski struck, killed on East 91st Street in Upper East Side

UPPER EAST SIDE, NY, (December 01, 2025) – An 85-year-old man, identified as Janus Gorzynski, was struck and killed Monday afternoon on the Upper East Side, according to the New York City Police Department. The collision happened around 2:42 p.m. on East 91st Street at Park Avenue as Gorzynski crossed east to west. Police said he was hit by a 67-year-old man driving a 2019 Mercedes Sprinter van westbound on East 91st Street while attempting a left turn. Gorzynski was rushed to NewYork-Presbyterian/Weill Cornell Medical Center, where he later died.

The driver remained at the scene. The investigation is ongoing.

CRASH INVESTIGATION NEEDED

Pedestrian fatalities remain a serious concern nationwide despite continued safety initiatives. According to the Governors Highway Safety Association (GHSA), approximately 2,304 pedestrians were killed in roadway crashes in the first half of 2024—numbers experts say are largely preventable when drivers remain alert.

“In most cases, pedestrians have the right of way when crossing an intersection, whether or not a crosswalk is marked,” said Candice Bond, an experienced pedestrian accident attorney.

Bond, Managing Partner of Bond Legal, emphasized that an independent investigation led by a skilled attorney can be essential in protecting the rights of a victim’s family in incidents like this.

“Factors such as road design, signage visibility, and lighting must all be carefully reviewed and analyzed to determine what contributed to the crash,” Bond said.

WRONGFUL DEATH CLAIM

“It is typically a driver’s responsibility to yield to a pedestrian,” said Stefano Formica, of counsel at Bond Legal. The family of Janus Gorzynski may have grounds to pursue a wrongful death claim.

“Families of wrongful death victims may seek compensation for loss of income, companionship, pain and suffering, funeral costs, and emotional distress after a devastating loss,” Formica said.

He added that insurance companies may push families toward fast, undervalued settlements. “An attorney will stand firmly on behalf of the family to ensure they receive fair treatment and appropriate compensation.”
