Pedestrian dies in Oceanside crash Valentin Hernandez taken into custody

OCEANSIDE, CA – April 16, 2026 – A 76-year-old pedestrian was killed early Thursday morning in a hit-and-run crash in Oceanside, California, according to police.

Authorities said the collision occurred near Mission Avenue and Mesa Drive at approximately 5:15 a.m. when a 2005 Toyota Tacoma traveling westbound struck a pedestrian in the roadway.

The pedestrian suffered fatal injuries and was pronounced dead at the scene. The victim’s identity was not immediately released.

Police said the driver fled after the crash but was later located and arrested. The suspect has been identified as Oceanside resident Valentin Hernandez.

Hernandez has been charged with driving under the influence and hit-and-run causing death. The investigation remains ongoing.

CRASH INVESTIGATION NEEDED

A driver involved in a hit-and-run collision is legally required to remain at the scene and report the incident to authorities. Failure to do so can result in serious criminal charges and additional legal consequences. According to NHTSA, 2,872 people died in hit-and-run crashes in 2023, a slight decrease from the previous year, suggesting a modest overall decline in such incidents nationwide.

“Proper investigative resources are essential in pedestrian crash cases to establish negligence,” said Candice Bond, an experienced hit-and-run accident attorney and Managing Partner of Bond Legal.

Added Bond, a national analyst for Accident Injury News, “Drivers are always required to exercise extreme caution while operating a vehicle.”

An attorney can evaluate all contributing factors in the crash and has the resources to retain expert witnesses, locate eyewitnesses, and review insurance coverage relevant to the case.

WRONGFUL DEATH CLAIM

Pending the outcome of the investigation, the family of the victim killed in the crash may have grounds to pursue a wrongful death claim. Families may seek compensation for loss of companionship, emotional suffering, and other damages resulting from a fatal incident.

“The emotional toll following the sudden loss of a loved one can be devastating,” said Stefano Formica, Of Counsel with Bond Legal.

“A wrongful death attorney can monitor the investigation closely and help ensure that the victim’s rights and the family’s legal interests are fully protected.”
