Patrick Kerby killed in Collins pedestrian crash on Route 39, NYSP reports

COLLINS, NY, (March 28, 2026) — A 47-year-old man was killed Saturday morning in a vehicle versus pedestrian crash in Collins, authorities said.

The Erie County Medical Examiner’s Office identified the victim as Patrick E. Kerby of Fleming, Florida. According to New York State Police, Kerby was walking along the eastbound lane of Route 39 at approximately 6:30 a.m. when he was struck by a 2013 Dodge Ram traveling east.

Kerby was pronounced dead at the scene. An autopsy later confirmed that he died from blunt force trauma, and the manner of death was ruled accidental.

The driver, a 52-year-old man, remained at the scene and cooperated with investigators. Authorities said he showed no signs of impairment, and no charges have been filed.

PEDESTRIAN ACCIDENT INVESTIGATION

Each year, a growing number of pedestrians lose their lives on roadways across the United States. Many of these incidents are preventable if drivers remain vigilant and attentive. According to the Governors Highway Safety Association, approximately 3,304 pedestrians were killed in the first half of 2024 alone.

“Having the proper resources is extremely important to investigate a pedestrian accident case and prove negligence,” said Candice Bond, Managing Partner of Bond Legal and an experienced pedestrian accident attorney.

“Factors such as road conditions, visibility of signage, and lighting must all be carefully reviewed as they may contribute to a crash,” Bond explained. “These steps are essential in helping families who have lost a loved one pursue justice.”

“An accident reconstruction team is sometimes necessary to determine exactly what occurred. These resources play a crucial role in helping clients obtain compensation for losses following a collision,” added Bond, a national legal analyst for Accident Injury News.

WRONGFUL DEATH CLAIM

“It is generally the responsibility of drivers to yield to pedestrians,” said Stefano Formica, Of Counsel at Bond Legal. The family of Patrick Kerby may have the right to pursue a wrongful death claim.

“Relatives of wrongful death victims may seek compensation for loss of income, companionship, pain and suffering, funeral costs, and emotional distress after a tragic accident,” Formica said.

An attorney can serve as an advocate, offering guidance during a difficult time while ensuring the family’s legal rights are protected.

“Insurance companies may attempt to push quick settlements that are far below what a claim is worth,” Formica added. “An attorney will fight to ensure clients are treated fairly and receive appropriate compensation.”
