Passenger Dies in San Antonio Crash, Fernandez Faces Charges

SAN ANTONIO, TX, (July 04, 2026) – A man is facing charges after a single-vehicle crash killed his 43-year-old passenger Saturday night on the Southeast Side of San Antonio.

San Antonio police say Nicholas Fernandez, 42, was traveling at a high rate of speed at approximately 8 p.m. on the eastbound access road of 9000 Southeast Loop 410 when his vehicle left the roadway, ejecting the passenger from the car.

The passenger, whose identity has not been released, was pronounced dead at the scene.

Fernandez has been charged with intoxication manslaughter and resisting arrest, search or transport.

FATAL SINGLE-VEHICLE ACCIDENT INVESTIGATION

Alongside the ongoing efforts of law enforcement, Candice Bond, a veteran auto accident attorney, noted that in incidents of this nature, having an experienced lawyer launch a swift, independent investigation is essential to safeguarding the rights of victims’ families.

“Time is of the essence, and families of victims must be ensured that evidence is reviewed in an efficient manner,” said Bond, Managing Partner at Bond Legal and a national analyst for Accident Injury News. “An attorney will carefully review what may have contributed to the crash and has the resources to hire expert witnesses, conduct driver background checks, locate witnesses to the crash and review applicable insurance coverage. Serving as an advocate, an attorney can help compassionately guide a family during this difficult time, while protecting their legal rights and best interests.”

Data from the National Safety Council shows that single-vehicle crashes — including collisions with fixed objects, pedestrians, and non-collision incidents — accounted for over half of all traffic fatalities and fatal crashes in the U.S. last year.

WRONGFUL DEATH CLAIM

Depending on the outcome of the investigation, the family of the 43-year-old passenger could be eligible to pursue a wrongful death claim. Families of wrongful death victims may be able to recover damages for loss of love and companionship, funeral expenses, pain and suffering, and emotional distress stemming from a tragic incident like this one.

“The stress and sorrow can be extremely overwhelming after losing a loved one in an accident,” said Stefano Formica, of counsel with Bond Legal. “We understand just what families are forced to go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help ensure that their legal rights and best interests are protected.”

“The passenger’s family may also be able to file a claim with the driver’s insurance company if the driver is found liable,” Formica added. “Doing so has no bearing on the family’s own insurance policy, since the claim would be made against a separate policy that isn’t theirs.”
