Oscar Martinez killed in Kern County train accident

BAKERSFIELD, CA, (March 20, 2026) — A 35-year-old man died after being struck by a train Friday morning in Bakersfield, according to officials.

The Kern County Coroner’s Office identified the victim as Oscar Martinez. Authorities said the incident occurred around 7 a.m. on railroad tracks south of Highway 58, west of Weedpatch Highway.

Martinez was transported to Kern Medical following the collision but later succumbed to his injuries.

The incident remains under investigation.

CRASH INVESTIGATION NEEDED

Each year, hundreds of fatalities occur in train-related incidents across the United States, often at poorly marked crossings or areas with inadequate fencing or malfunctioning signals. According to the National Safety Council, 954 railroad deaths were reported in 2024, a slight decrease from 967 in 2023.

Candice Bond, an experienced train accident attorney, stated that in cases like this, it is essential to conduct an independent investigation as quickly as possible to preserve crucial evidence for the victim’s family.

“A knowledgeable attorney can help protect grieving families from large rail companies, which often deploy their own investigators and have extensive resources to defend against liability,” said Bond, Managing Partner of Bond Legal.

“Time is critical in these cases, and it is important that evidence is carefully and efficiently reviewed.”

WRONGFUL DEATH CLAIM

Pending the investigation, the family members of Oscar Martinez may be eligible to pursue a wrongful death claim. Families of wrongful death victims may seek damages for loss of companionship, pain, suffering, and emotional distress following such a tragic accident.

“The grief and stress following the loss of a loved one can be overwhelming,” said Stefano Formica, Of Counsel with Bond Legal.

“A wrongful death attorney will stay informed about the investigation and help ensure that the victim’s legal rights and best interests are protected.”
