DPS: Oscar Hernandez killed after intersection crash in Odessa

ODESSA, TX (May 23, 2026) — A 39-year-old man identified as Oscar Hernandez was killed early Saturday morning in a two-vehicle crash in West Odessa, according to the Texas Department of Public Safety.

Authorities said Hernandez was driving a Volkswagen Polo westbound on 16th Street at approximately 5:10 a.m. when a Chevrolet Silverado traveling north on Tripp Avenue entered the intersection without stopping and struck the passenger side of his vehicle.

The impact forced both vehicles into the southwest corner of the intersection, where they collided with a fence and a utility box.

Hernandez, who was wearing a seat belt, was pronounced dead at the scene. An 18-year-old passenger in his vehicle also died at the crash site.

The driver of the Chevrolet Silverado sustained minor injuries and was transported to Medical Center Hospital in Odessa for treatment.

Officials said criminal charges remain pending, subject to toxicology results, as the investigation continues into the circumstances of the crash.

FATAL TWO-VEHICLE ACCIDENT INVESTIGATION

The DPS said criminal charges remain pending pending toxicology analysis as the investigation into the crash continues.

According to the Federal Highway Administration, nearly 40% of vehicle collisions occur at intersections. Common causes include failure to yield right of way, impatience, reckless driving, and driver distraction.

Candice Bond, an experienced auto accident attorney, stated that cases of this nature often require an independent review to ensure all factors contributing to the crash are properly identified.

“It is imperative to come to a determination of the exact cause of these types of accidents,” said Bond, Managing Partner with Bond Legal and a national analyst for Accident Injury News. “An attorney has the resources to review applicable insurance coverage, hire expert witnesses, run background checks, and locate witnesses. We carefully guide the family of the victim through the process.”

She added, “In addition to a police report, an attorney will carefully review what may have contributed to the crash. Serving as an advocate, an attorney can help guide victims and families of victims through what can be a complicated process.”

WRONGFUL DEATH CLAIM

Pending the outcome of the investigation, the family of Oscar Hernandez may consider pursuing a wrongful death claim. Family members of wrongful death victims may seek damages for loss of love and companionship, funeral expenses, pain and suffering, and emotional distress following a fatal accident such as this.

“Stress and sorrow can be extremely overwhelming after losing a loved one in an accident,” said Stefano Formica, of counsel at Bond Legal. “We understand just what families must go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help ensure that their legal rights and best interests are protected.”
