CHP: Martin Enciso Jr. Fatally Struck on Freeway in Arleta

FATAL PEDESTRIAN ACCIDENT INVESTIGATION

California has long struggled with pedestrian safety on its roads and freeways. According to the state’s Office of Traffic Safety, nearly 7,500 pedestrians died in California between 2009 and 2018 alone. The state holds the grim distinction of recording the highest number of pedestrian fatalities in the nation, with a pedestrian fatality rate nearly 25% above the national average.

Nationally, the picture is equally concerning. Data from the Governors Highway Safety Association indicates that pedestrian fatalities in the United States have grown substantially faster than all other categories of traffic deaths, with an estimated 6,590 pedestrian fatalities recorded in 2019 — the highest figure in more than 30 years.

“Road conditions, visibility, and lighting are all possible contributing factors considered and examined,” said Candice Bond, Managing Partner with Bond Legal and a national analyst for Accident Injury News. “An accident reconstruction team is sometimes needed to help piece together what happened. All of these resources are necessary for helping clients receive monetary compensation for damages or a loss following a collision.”

WRONGFUL DEATH CLAIM

The family of Martin Enciso Jr. may have legal grounds to pursue a wrongful death claim seeking damages for loss of love and companionship, funeral costs, emotional trauma, and pain and suffering resulting from the fatal crash.

“It is almost always a driver’s duty to yield to any pedestrian,” said Stefano Formica, of counsel at Bond Legal. “Serving as an advocate, an attorney can help compassionately guide a family through this difficult time while protecting their rights.”

“Insurance companies often try to pressure victims to settle for a quick payout for far less than the case is worth. However, an attorney will vigorously advocate for their client to ensure that they are treated with respect and compensated fairly,” Formica added.

Families who have lost a loved one in a pedestrian crash are urged to seek experienced legal counsel promptly to ensure their rights are fully protected and that any settlement pursued reflects the true value of their loss.
