Marcial Romero killed by hit-and-run DUI driver in Santa Fe NM

SANTA FE, NM, (April 19, 2026) — Authorities have identified a pedestrian who was fatally struck by an alleged impaired driver early Sunday morning in Santa Fe.

According to police, Marcial Romero, 41, was hit by a vehicle at approximately 2:05 a.m. near the intersection of Agua Fria Street and Cottonwood Drive.

Romero was transported to a local hospital following the collision, where he later succumbed to his injuries.

Officials said the driver involved in the crash was arrested and charged with Homicide by Vehicle, specifically for driving while under the influence of intoxicating liquor or drugs.

The incident remains under investigation.

FATAL DUI ACCIDENT INVESTIGATION

Impaired driving is a leading factor in pedestrian-related crashes, as alcohol and drugs can significantly impair judgment, slow reaction times, and reduce motor coordination.

According to the National Highway Traffic Safety Administration (NHTSA), nearly 30 people die each day in the United States due to drunk-driving crashes—equating to one fatality approximately every 50 minutes. Data from the Centers for Disease Control and Prevention (CDC) also indicate that drugs other than alcohol are involved in about 18 percent of motor vehicle driver fatalities nationwide.

Candice Bond, an experienced DUI accident attorney, addressed the legal implications of such incidents.

“Separate from any criminal proceedings, a victim’s family may pursue compensation through a civil lawsuit against the responsible party,” said Candice Bond, Managing Partner of Bond Legal and national analyst with Accident Injury News. “Beyond the work conducted by law enforcement, an attorney can re-examine key witnesses, review surveillance footage, and obtain phone and text records of the at-fault driver. Acting as an advocate, legal counsel helps guide families through this difficult time while protecting their rights and seeking accountability for reckless actions.”

WRONGFUL DEATH CLAIM

The family members of Marcial Romero may be eligible to file a wrongful death claim. In such cases, surviving relatives may seek compensation for loss of companionship, emotional suffering, and other damages resulting from a tragic accident.

“The emotional toll following the loss of a loved one in an accident can be overwhelming,” said Candice Bond, Managing Partner at Bond Legal. “We understand the challenges families face, and ensuring their legal rights are protected is critical. A wrongful death attorney will monitor the investigation and work to safeguard the family’s best interests throughout the process.”
