Joseph Nicholas Grammer tragically killed in Polk County motorcycle accident

POLK COUNTY, Ore. — A motorcyclist died Sunday evening in a two-vehicle crash on Highway 18 in Polk County, Oregon State Police said in a news release.

Joseph Nicholas Grammer, 50, of Grand Ronde was pronounced dead at the scene after his Kawasaki ZX-18 motorcycle collided with a Freightliner commercial truck near milepost 27 at 7:07 p.m.

Police said the Freightliner, operated by a 19-year-old Salem man, was traveling eastbound when it made a left turn into a gravel lot. The truck entered the path of Grammer’s westbound motorcycle, which struck the side of the truck.

The truck driver was not injured in the crash.

The highway remained closed for approximately three hours during the investigation. The cause of the crash remains under investigation.

The Polk County Sheriff’s Office and Yamhill County Sheriff’s Office assisted Oregon State Police at the scene.

CRASH INVESTIGATION

Motorcycle accidents in Oregon remain a serious concern, as evidenced by the Oregon Department of Transportation and federal data, which consistently highlight risks to riders.

In 2022, Oregon reported 101 motorcycle fatalities, which made up over 18% of all traffic deaths statewide. The fatality rate was approximately 7.39 per 10,000 registered motorcycles, placing Oregon among the more dangerous states for motorcyclists.

In the previous year, there were 1,520 reported motorcycle crashes, resulting in 64 deaths and more than 1,200 injuries. On average, about 1% of registered motorcyclists in the state are involved in crashes annually, with approximately 4% of those incidents proving fatal.

Rear-end impacts and crashes involving disabled vehicles on the shoulder were frequent, particularly in rural areas. Counties such as Craighead, Pulaski, and Washington reported some of the highest numbers of truck-related accidents.

Candice Bond, an experienced tractor-trailer accident attorney, said that in such cases, it is imperative to have an independent investigation conducted promptly to protect the rights of a victim.

“Tractor-trailer crashes are often complex, and many factors can play a role in these types of accidents,” said Bond, who is a Managing Partner of Bond Legal.

“A skilled attorney can protect victims from trucking companies, which often send their own investigators to crash sites and possess a variety of resources they can utilize to defend a negligent truck driver.

“Your lawyer can advocate for you by hiring expert witnesses, conducting driver background checks, locating witnesses to the crash, and reviewing applicable insurance coverage, while carefully guiding a victim through the legal process.”

WRONGFUL DEATH CLAIM

The family of Joseph Grammer may pursue compensation for damages such as costs associated with the death, loss of income and companionship, and other hardships.

“A death to a family member after an accident is both tragic and devastating to a surviving family. The grief, shock, and anger can be overwhelming,” said Bond.

She added, “Aside from the emotional suffering of those left behind, the death of someone close can have devastating financial implications. Loss of income and funeral costs alone can have tragic consequences when a family member is lost.”
