Joel Mota tragically killed in Bay Ridge DUI-related moped accident

BROOKLYN, N.Y. — A moped driver died Saturday morning after colliding with a car in Bay Ridge, the New York Police Department reported.

Joel Mota, 22, of Sunset Park was pronounced dead at NYU Langone Hospital–Brooklyn. Mota suffered serious injuries to his head and torso, according to NYPD.

Officers responded to the accident at Third Avenue and 67th Street at around 4:45 a.m. The collision occurred when the moped struck a car’s passenger-side door.

A 21-year-old man riding as a passenger on the moped sustained multiple fractures to his left arm and leg. He was also transported to the hospital.

A 29-year-old Sheepshead Bay woman was driving a 2013 Acura TSX west on 67th Street. Mota was traveling south on Third Avenue when the vehicles collided.

NYPD officers arrested the driver on charges of driving while intoxicated and without a license. She was taken to the hospital in stable condition.

Mota lived less than a half-mile from the crash site, authorities said.

The accident remains under investigation.

DUI ACCIDENT INVESTIGATION

New York State has experienced a dangerous uptick in drunken driving fatalities, with deaths from alcohol-related traffic crashes climbing nearly 30% in recent years according to state police.

The state recorded more than 7,000 alcohol-related traffic crashes in 2022, resulting in 335 deaths—a stark increase from the 262 fatalities reported in 2019. This troubling trend means that slightly more than 30% of all fatal crashes in New York State now involve alcohol.

“Drunken and drugged drivers are subject to criminal charges following an accident or collision that causes harm or kills another person,’’ explained Candice Bond, a Managing Partner at Bond Legal.

She added, “Separate from criminal charges, the family of a victim may be entitled to compensation through a civil lawsuit against the responsible party.”

The National Safety Council reports that impaired driving—whether due to alcohol, drugs, or other medications—accounts for 10 percent of all fatal automobile accidents. These crashes rank as the second-leading cause of traffic fatalities in the country.

WRONGFUL DEATH CLAIM

Pending the investigation, the family of Joel Mota may pursue a wrongful death claim. Family members of wrongful death victims may seek damages for loss of companionship, pain and suffering, and emotional distress following a tragic or catastrophic accident such as this.

“The stress and sorrow can be extremely overwhelming after losing a loved one in an accident,” said Bond.

“We understand just what families must go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help ensure that their legal rights and best interests are protected.”
