Janice Rozellen Schwarz charged with DUI manslaughter in Marion County bicycle crash

MARION COUNTY, Fla. — The Florida Highway Patrol is investigating a crash on June 7 that claimed the life of a bicycle rider.

FHP said the incident occurred at around 2 a.m. along State Road 25 at S.E. 80th Court. The crash resulted in DUI manslaughter charges against a Fruitland Park woman.

Troopers said 34-year-old Janice Rozellen Schwarz struck and killed a 37-year-old Ocala man who was riding his bicycle on the shoulder of the highway. Marion County Fire Rescue pronounced the victim dead at the scene.

Schwarz was driving westbound on State Road 25 when the front of her vehicle hit the rear of the bicycle. The bicyclist was traveling west when the collision occurred.

Schwarz sustained minor injuries in the crash and was transported for medical treatment. Police later took her into custody and booked her at the Marion County Jail. She faces charges including DUI manslaughter in connection.

The crash remains under investigation by Florida Highway Patrol.

DUI ACCIDENT INVESTIGATION

Yet another life has been lost due to the reckless decision to drive while intoxicated—a tragedy that experts agree is entirely preventable when making responsible choices.

The Centers for Disease Control and Prevention reported that substances other than alcohol contribute to approximately 18 percent of motor vehicle driver fatalities in the U.S., but any psychoactive drug impairs driving ability, putting all others at risk.

Candice Bond, a seasoned DUI accident attorney, shared her perspective on cases like this.

“Separate from criminal charges, a victim’s family may be entitled to compensation through a civil lawsuit against the responsible party,” said Bond, Managing Partner of Bond Legal and national analyst for Accident Injury News.

“As an advocate, an attorney can compassionately guide grieving families through this challenging period, protecting their legal rights and ensuring that a drunk driver is held accountable for their reckless actions.”

WRONGFUL DEATH CLAIM

Pending the investigation, the family of a victim may pursue a wrongful death claim. Family members of wrongful death victims may seek damages for loss of companionship, pain and suffering, and emotional distress following a tragic or catastrophic accident such as this.

“The stress and sorrow can be extremely overwhelming after losing a loved one in an accident,” said Bond.

“We understand just what families must go through, and having their rights protected is vital. A wrongful death lawyer will stay updated on the official investigation and help ensure that their legal rights and best interests are protected.”
