James Thomas charged in Whitney pedestrian DWI crash

WHITNEY, TX, (March 31, 2026) — A pedestrian was killed Tuesday morning after being struck by an alleged intoxicated driver along Farm Road 2604 in Whitney, according to authorities.

The Texas Department of Public Safety reported that an unidentified woman was walking along the roadway when a Jeep sport-utility vehicle driven by 56-year-old James Thomas veered onto the shoulder at approximately 11 a.m. The vehicle struck the pedestrian, who was pronounced dead at the scene.

Investigators determined that Thomas, a Hillsboro resident, was intoxicated at the time of the crash. He was arrested and charged with felony intoxication manslaughter. The incident remains under investigation.

DWI CRASH INVESTIGATION

Drunk driving frequently leads to pedestrian crashes because alcohol affects judgment, slows reaction times, and impairs coordination.

According to the Texas Department of Transportation, a person dies every nine hours and six minutes in DUI-alcohol-related traffic crashes. Last year, 963 people in Texas were killed and 2,114 seriously injured due to impaired drivers.

Candice Bond, an experienced DUI accident attorney, shared her perspective on incidents like this.

“Beyond any criminal charges, a victim’s family may have the right to pursue compensation through a civil lawsuit against the responsible party,” said Candice Bond, Managing Partner of Bond Legal and a national analyst with Accident Injury News. “Along with law enforcement efforts, an attorney can revisit key witnesses, review surveillance footage, and obtain phone and text records from the liable party. Acting as an advocate, an attorney can help guide a grieving family through this difficult time while protecting their legal rights and ensuring accountability.”

WRONGFUL DEATH CLAIM

The family members of the victim killed in this accident may have the right to pursue a wrongful death claim. Relatives of wrongful death victims may seek compensation for loss of companionship, pain, suffering, and emotional distress following a tragic accident.

“We understand the immense hardship families face after such a loss, and protecting their rights is crucial,” said Stefano Formica, Of Counsel with Bond Legal. “A wrongful death attorney will monitor the official investigation and help ensure that the family’s best interests are represented. Loved ones may pursue damages for loss of companionship, pain and suffering, and emotional distress following a catastrophic incident.”
