James Elkins dies after Barboursville WV pedestrian crash

BARBOURSVILLE, WV (March 30, 2026) — An 89-year-old Lincoln County man was killed Monday morning in a pedestrian crash in Barboursville, according to police.

Authorities identified the victim as James Elkins, who was collecting aluminum cans near U.S. 60 close to Jolly Pirate Donuts when he was struck by a passing vehicle.

Police said the driver attempted to swerve to avoid hitting Elkins but was unable to do so. Elkins sustained fatal injuries and was pronounced dead following the collision.

Officials reported no signs of impairment or speeding, and no charges have been filed. The driver’s identity has not been released. The incident is being treated as an accident.

PEDESTRIAN ACCIDENT INVESTIGATION

Each year, a growing number of pedestrians lose their lives on roadways across the United States. Many of these incidents could be prevented if drivers remain vigilant and attentive. According to the Governors Highway Safety Association, approximately 3,304 pedestrians were killed on U.S. roads during the first half of 2024.

“Having the proper resources is extremely important to investigate a pedestrian accident case and prove negligence,” said Candice Bond, Managing Partner of Bond Legal and an experienced pedestrian accident attorney.

“Road conditions, signage visibility, and road lighting are all contributing factors that must be carefully reviewed and analyzed. These steps are critical in helping families who have lost a loved one pursue justice,” Bond added.

“In some cases, an accident reconstruction team is necessary to determine exactly what occurred. These resources play a key role in helping clients secure financial compensation after a serious or fatal crash,” said Bond, a national legal analyst for Accident Injury News.

WRONGFUL DEATH CLAIM

“It is almost always a driver’s duty to yield to any pedestrian,” said Stefano Formica, of counsel at Bond Legal. The family of James Elkins may have the right to pursue a wrongful death claim.

“Family members of wrongful death victims may seek damages for loss of income and companionship, pain and suffering, funeral expenses, and emotional distress following a tragic or catastrophic accident,” Formica explained.

An attorney can serve as an advocate, helping guide families through this challenging time while ensuring their legal rights are protected.

“Insurance companies often attempt to pressure victims into accepting quick settlements for far less than a case may be worth,” Formica added. “However, an attorney will strongly advocate on behalf of their client to ensure fair treatment and appropriate compensation.”
