WCS: Hit-and-run crash injures Kirk Avering in Queensbury

QUEENSBURY, NY, January 07, 2026 — A Queensbury man was seriously injured early Wednesday morning when his mobility scooter was struck by a hit-and-run driver on Bay Road, according to the Warren County Sheriff’s Office.

Deputies said 60-year-old Kirk Avering was operating his mobility scooter shortly after 6 a.m. when he was hit by a vehicle that fled the scene. Authorities later arrested an Albany resident in connection with the crash.

The suspect was charged with driving while intoxicated and leaving the scene of a personal injury accident. Avering was transported to Albany Medical Center for treatment. The investigation remains ongoing.

CRASH INVESTIGATION NEEDED

Despite repeated warnings, public awareness efforts, and the tragic consequences that follow, many drivers still flee crash scenes, leaving injured victims behind. According to the AAA Foundation for Traffic Safety, more than one hit-and-run collision occurs every minute on roadways across the United States, with an estimated average of 682,000 such crashes occurring annually since 2006.

Candice Bond, an experienced hit-and-run accident attorney, said that incidents like this underscore the importance of launching an independent investigation as soon as possible to protect the rights of injured victims.

“Having the proper resources is essential to thoroughly investigate a hit-and-run case and establish negligence,” said Bond, Managing Partner of Bond Legal.

“These investigative steps are critical to helping injured victims pursue justice and obtain the financial compensation they deserve, while also ensuring that reckless drivers are held accountable for their actions,” Bond added.

PERSONAL INJURY CLAIM

Pending the outcome of the investigation, Kirk Avering may have the right to pursue a personal injury claim. Bond noted that the physical, emotional, and financial strain following a serious injury can be overwhelming and may affect nearly every aspect of a victim’s life, including work, family responsibilities, and overall well-being.

“It is important for injury victims to retain an attorney when pursuing a personal injury claim, as legal counsel can handle negotiations with insurance companies on a client’s behalf,” said Stefano Formica, Managing Partner with Bond Legal.

“Insurance companies often attempt to pressure injured individuals into accepting quick settlements for far less than a claim may be worth,” Formica added. “An attorney, however, will aggressively advocate for their client to ensure fair treatment and appropriate compensation.”
