Heather Avery killed in Chambers Co I-10 truck accident, DPS says

WINNIE, TX, (April 24, 2026) – A 48-year-old woman serving as an off-duty reserve deputy constable was tragically killed Friday morning in a work zone crash along Interstate 10 near Winnie, according to the Texas Department of Public Safety (DPS).

Heather Avery was working traffic control for a private contractor on eastbound I-10 when the crash occurred at approximately 7:40 a.m. Authorities said Avery was inside a Ford Explorer with emergency lights activated in the outside lane near milepost 830 when a Mack truck traveling eastbound rear-ended the vehicle.

Avery was pronounced dead at the scene.

The truck driver, identified as a 30-year-old man from Dickinson, was not injured in the collision.

Avery served as a Reserve Deputy Constable with the Jefferson County Precinct 1 Constable’s Office and was widely respected as a firearms expert and instructor.

DPS officials confirmed that the investigation into the crash remains ongoing.

CRASH INVESTIGATION

Candice Bond, an experienced tractor-trailer accident attorney, emphasized that in incidents like this, a prompt and independent investigation is critical to protect the victim’s rights.

“Crashes involving tractor-trailers are often highly complex, with multiple contributing factors,” said Bond, Managing Partner of Bond Legal.

“An experienced attorney can help safeguard victims against trucking companies, which frequently deploy their own investigators and have extensive resources to defend negligent drivers.

“A lawyer can support victims by securing expert testimony, reviewing the driver’s history, identifying witnesses, and analyzing insurance coverage, all while guiding families through the legal process.”

WRONGFUL DEATH CLAIM

The family of Heather Avery may seek compensation for damages, including funeral costs, loss of income, loss of companionship, and other related hardships.

“The loss of a loved one in a crash is both tragic and life-altering for a family. The emotional burden can be immense,” said Stefano Formica, Of Counsel with Bond Legal.

He added, “Beyond the grief, families often face serious financial challenges. Lost income and funeral expenses can create significant hardship after such a devastating loss.”
