FATAL MOTORCYCLE ACCIDENT INVESTIGATION

Authorities continue to investigate the fatal crash as a family grieves.

Sadly, about 36,000 people die in motor vehicle accidents each year in this country. According to the National Highway Traffic Safety Administration, speeding remains the leading cause of fatal crashes, followed by alcohol or drug impairment, failure to maintain proper lanes, failure to yield the right of way, and distracted driving.

Candice Bond, Managing Partner at Bond Legal, explained that in cases like this, it is important to conduct a thorough independent investigation with the help of an experienced attorney. This process can assist victims and their families when dealing with insurance companies.

Bond, a national analyst for Accident Injury News, emphasized that while no financial recovery can replace a lost loved one, proper legal representation is essential.

“Insurance companies often attempt to pressure victims and families into accepting quick settlements that may be far below the true value of a claim,” Bond said. “They are motivated to limit payouts and may not account for long-term suffering and losses. Attorneys work to ensure their clients are treated fairly and receive appropriate compensation.”

WRONGFUL DEATH CLAIM

Based on the information provided thus far, the family of Hayley Smith may be entitled to a wrongful death claim covering damages for funeral costs, loss of love and companionship, emotional trauma, and pain and suffering.

“A wrongful death claim is a civil action brought by the estate or family members of a deceased individual seeking financial compensation,” Bond said. “This type of case is separate and distinct from any criminal proceedings.”

“The passenger may also file a claim with the insurance provider of the vehicle they were in if the driver is found liable,” said Stefano Formica, Of Counsel at Bond Legal. “Such a claim does not affect their own insurance policy since it is made against another party’s coverage.”
