Guisela Garay Faces DWI Charges After Franklin Square Crash

FRANKLIN SQUARE, NY, (September 24, 2026) – Guisela Garay, 24, was arrested Thursday night after allegedly striking another vehicle while driving intoxicated in Franklin Square, according to the Nassau County Police Department.

Garay was driving a Toyota northbound on Franklin Avenue shortly before 9 p.m. when her vehicle collided with a BMW that was attempting to turn westbound onto Cloud Avenue.

The BMW’s driver, a 39-year-old man, suffered severe trauma to his legs and body in the crash. He was transported to a local hospital in critical condition. Police did not release his identity.

Garay was arrested at the scene and charged with DWI, first-degree vehicular assault, second-degree vehicular assault and first-degree aggravated unlicensed operation.

Anyone with further information is asked to contact the Nassau County Police Department.

DUI ACCIDENT INVESTIGATION

Impaired drivers pose a serious risk to everyone on the road and can cause devastating consequences for others.

“Drunken and drugged drivers are subject to criminal charges following an accident or collision that causes harm or kills another person,” explained Candice Bond, a Managing Partner at Bond Legal.

“Separate from criminal charges, the family of a victim may be entitled to compensation through a civil lawsuit against the responsible party,” said Bond, an experienced DUI accident attorney.

According to the National Safety Council, drivers operating vehicles under the influence of alcohol, drugs, or other medications are responsible for 10 percent of all fatal automobile accidents. These crashes are the second-leading cause of automobile fatalities in the country.

PERSONAL INJURY CLAIM

An injured victim may have the right to pursue a personal injury claim while the circumstances of the collision are being investigated.

Stefano Formica, of counsel at Bond Legal, said, “Injured victims involved in a collision often seek a personal injury claim to cover the cost of medical bills, future medical care, loss of income, emotional trauma, and pain and suffering.”

“Insurance companies can be notoriously unconcerned with the mounting costs that an injured party may accrue. An attorney can help. We protect the victims of these tragedies daily, forcing the insurance companies to pay for their mistakes,” he added.
