FATAL PEDESTRIAN ACCIDENT INVESTIGATION

Authorities continue to investigate the crash, another tragic example highlighting the risks pedestrians face while traveling across Texas roadways.

According to the Texas Department of Transportation, 5,975 pedestrian-involved crashes occurred in Texas in 2019, resulting in 669 fatalities, marking a 5% rise compared to the previous year.

“Road conditions, visibility, and lighting are among the potential contributing factors that are carefully reviewed,” said Candice Bond, Managing Partner with Bond Legal and a national analyst for Accident Injury News. “In many cases, accident reconstruction specialists are brought in to determine exactly what transpired. These efforts are crucial in helping families pursue compensation after a devastating loss.”

Data from the Governors Highway Safety Association shows pedestrian deaths in the United States have risen significantly faster than other traffic-related fatalities. In 2019, an estimated 6,590 pedestrians were killed—the highest figure in more than three decades. Additionally, about 150,000 pedestrians were injured in 2018, according to the National Safety Council.

WRONGFUL DEATH CLAIM

The family of Fatima Lucero Peralta may have the right to pursue a wrongful death claim, seeking damages for loss of companionship, funeral expenses, emotional suffering, and other hardships.

“It is generally the responsibility of drivers to yield to pedestrians whenever possible,” said Stefano Formica, of counsel at Bond Legal. “An experienced attorney can serve as a strong advocate, guiding families through the legal process with care while ensuring their rights are upheld.”

Formica added, “Insurance companies may attempt to push families into quick settlements that undervalue their loss. Having legal representation ensures that victims’ families are treated fairly and receive the compensation they deserve.”
