SUFFIELD TOWNSHIP, Ohio— A dump truck struck Evan Lab while he was crossing state Route 43 on April 18, leaving him dead at the scene.
The accident happened around noon, approximately half a mile south of the Mogadore Reservoir. Authorities reported that 29-year-old Lab was crossing the road from the east side when he was hit by the northbound 2015 Freightliner dump truck.
Emergency responders transported Lab to the Cuyahoga County Medical Examiner’s Office. The truck driver, a 56-year-old Paris Township man, did not report any injuries.
The Ohio State Highway Patrol stated that speed, drugs, and alcohol did not appear to be factors in the accident.
Multiple agencies assisted at the scene, including the Portage County Sheriff’s Office, Suffield Township Fire and EMS, and Brimfield Police.

PEDESTRIAN ACCIDENT INVESTIGATION
Candice Bond, an experienced commercial accident attorney, said that in such cases, it is imperative to have an independent investigation conducted promptly to protect the rights of a victim.
“Commercial accidents are often complex, and many factors can play a role in these types of accidents,” said Bond, a Managing Partner of Bond Legal.
“A skilled attorney can protect victims from trucking companies, which often send their own investigators to crash sites and possess a variety of resources they can utilize to defend a negligent truck driver.
“Your lawyer can advocate for you by hiring expert witnesses, conducting driver background checks, locating witnesses to the crash, and reviewing applicable insurance coverage, while carefully guiding a victim through the legal process.”
WRONGFUL DEATH CLAIM
“It is almost always a driver’s duty to yield to any pedestrian,” said Bond. The family of Evan Lab may be entitled to a wrongful death claim.
“Family members of wrongful death victims may seek damages for loss of income and companionship, pain and suffering, funeral expenses, and emotional distress following a tragic or catastrophic accident,” she added.
Serving as an advocate, an attorney can help compassionately guide a family through this difficult time while protecting their rights.
“Insurance companies often try to pressure victims to settle for a quick payout for far less than the case is worth,” Bond noted. “However, an attorney will vigorously advocate for their client to ensure that they are treated with respect and compensated fairly.”
