Donald Baily killed on Highway 2 in Airway Heights collision

AIRWAY HEIGHTS, WA, January 07, 2026 — A pedestrian was killed early Wednesday morning after being struck by a suspected impaired driver on Highway 2 in Airway Heights, according to the Spokane County Sheriff’s Office.

Court records identified the victim as Donald Baily. Deputies said the crash occurred around 1:15 a.m. near South Centre Place as a 22-year-old male driver was traveling eastbound when he struck a pedestrian walking along the shoulder of the roadway.

Authorities reported the driver exited his vehicle and searched the area, believing he may have hit a person or an animal. After finding no one, he drove to a nearby parking lot and waited for police. The driver was later evaluated by a Drug Recognition Expert and charged with vehicular homicide. The investigation remains ongoing.

CRASH INVESTIGATION NEEDED

Impaired motorists, whose judgment and reaction times are significantly reduced, pose a heightened risk of causing fatal crashes. These preventable incidents continue to devastate families nationwide. According to the National Highway Traffic Safety Administration, an average of approximately 11,000 people lost their lives each year in drunk-driving crashes during the 10-year period from 2014 to 2023.

Candice Bond, an experienced DUI accident attorney, weighed in on cases involving suspected impaired driving.

“Independent of any criminal proceedings, a victim’s family may have the right to pursue compensation through a civil lawsuit against the at-fault driver,” said Bond, Managing Partner of Bond Legal and a national analyst for Accident Injury News.

“Factors such as blind spots, inexperience behind the wheel, and distracted driving frequently contribute to these collisions. An attorney can serve as an advocate, guiding families through an incredibly difficult period while working to ensure that negligent drivers are held accountable for violating traffic laws,” Bond added.

WRONGFUL DEATH CLAIM

Pending the outcome of the investigation, the family of Donald Baily may have grounds to pursue a wrongful death claim seeking compensation for medical and funeral expenses, loss of love and companionship, pain and suffering, and emotional trauma.

“A death may be considered wrongful when it results from a negligent or unlawful act committed by another person or entity,” said Stefano Formica, Of Counsel with Bond Legal.

“When fatal vehicle crashes are caused by unsafe driving behaviors such as distraction, speeding, aggressive driving, hit-and-run actions, or driving under the influence, surviving family members are often left with the option of pursuing a civil claim against the responsible motorist,” Formica explained.
