Daniel Garcia tragically killed in East Baton Rouge Parish hit-and-run accident

BATON ROUGE, La. — A 36-year-old man was killed in an early morning hit-and-run crash on LA-327 Spur near Rush Avenue that authorities are investigating.

Daniel Garcia of Baton Rouge was walking in the northbound lane of LA-327 Spur near the Rush Avenue intersection between 3:45 a.m. and 5 a.m. June 23. An unknown vehicle traveling northbound struck Garcia during this timeframe.

The driver fled the scene without calling for assistance or rendering aid to Garcia. Emergency responders pronounced Garcia deceased at the scene.

Louisiana State Police began investigating the fatal crash shortly before 8:30 a.m.

Troopers are working to identify the vehicle and its driver involved in the fatal collision. Authorities have not released details about the type of vehicle that struck Garcia. They are seeking public assistance and urging anyone with information related to the crash to come forward.

FATAL ACCIDENT INVESTIGATION

Louisiana ranks as the second deadliest state for pedestrians with a fatality rate of 3.98 per 100,000 people, nearly double the national average of 2.23, according to Axios New Orleans.

The Center for Analytics and Research in Transportation Safety at LSU reported that 145 of Louisiana’s 799 traffic fatalities in 2023 were pedestrians, while the Governors Highway Safety Association found the state logged 78% more pedestrian fatalities than the national average in 2022.

Nationally, the Insurance Institute for Highway Safety reported that 25% of pedestrian deaths in 2022 occurred in hit-and-run crashes, up from 20% between 2013-2019. This suggests that Louisiana’s pedestrian crisis is worsened by drivers fleeing accident scenes.

Despite these efforts, traffic fatalities increased 18.4% in the first half of 2021 compared to 2020, highlighting the ongoing challenge of protecting pedestrians on New York’s roads.

Candice Bond, an experienced hit-and-run accident attorney, said in such cases is imperative to have an independent investigation conducted by a seasoned attorney promptly to protect the rights of a victim.

“Having the proper resources is extremely important to investigate a hit-and-run accident case and prove negligence,” said Bond, a Managing Partner of Bond Legal.

“Road conditions, visibility, and lighting are all possible contributing factors considered and examined,” said Bond.

These procedures are necessary for helping someone who has lost a loved one at the hands of a hit-and-run driver receive the justice and monetary compensation they deserve.

WRONGFUL DEATH CLAIM

Pending the investigation, the family of Daniel Garcia may be entitled to a wrongful death claim for funeral expenses, the loss of love and companionship, pain and suffering, and emotional trauma.

“An incident is considered a wrongful death when either a person or entity commits a wrongful or negligent act resulting in death,” said Bond. “When vehicle accident fatalities result from unsafe driving, aggressive or distracted driving, speeding, or driving under the influence, family members are usually left with the option to pursue a civil action against the responsible motorist.”
