Carlos Michilena struck, killed by train in Charlotte: CMPD

CHARLOTTE, NC (April 19, 2026) — The Charlotte-Mecklenburg Police Department is investigating a fatal train-versus-pedestrian accident that occurred early Saturday near the intersection of North Tryon Street and Orr Road.

Authorities reported that Carlos Jamel Michilena was at the crossing around 5:47 a.m. when he entered the path of an oncoming CATS Lynx Blue Line train.

The train was traveling southbound into the intersection when Michilena moved into its line of travel. Despite the operator sounding the horn and activating emergency braking, the train struck him.

Emergency responders arrived to find Michilena unresponsive. He was transported to a nearby hospital, where he later died from his injuries the following day.

Investigators stated that all safety systems at the crossing were functioning properly at the time of the incident. The CMPD Major Crash Investigation Unit is leading the case.

TRAIN ACCIDENT INVESTIGATION

According to the Federal Railroad Administration, railroad-related incidents across the United States result in approximately 950 fatalities and over 6,500 injuries annually.

These incidents include those involving pedestrians, trespassers, railroad workers, passengers, and individuals in highway-rail crossing accidents.

FRA data indicates that such crashes may be caused by multiple factors, including human error, track issues, mechanical malfunctions, signal failures, communication breakdowns, or unauthorized presence on railway property.

Candice Bond, Managing Partner of Bond Legal and an experienced train accident attorney, emphasized that these elements are typically reviewed during investigations and highlighted the value of an independent legal evaluation.

“Train crashes are often complicated, with several contributing factors involved,” Bond said. “An experienced attorney can help protect a victim’s family, especially since train companies often deploy their own investigators and resources to defend against liability. Legal counsel can secure expert analysis, identify witnesses, review insurance coverage, and guide families through the legal process while safeguarding their interests.”

WRONGFUL DEATH CLAIM

Pending the outcome of the investigation, the family of Carlos Michilena may have grounds to pursue a wrongful death claim. Families of victims may seek compensation for loss of companionship, emotional suffering, and other damages resulting from a tragic incident like this.

“The emotional toll after losing a loved one in an accident can be overwhelming,” said Stefano Formica, Of Counsel with Bond Legal. “We understand the challenges families face, and protecting their legal rights is essential. A wrongful death attorney can monitor the investigation and help ensure that the family’s best interests are represented throughout the process.”
