NEW HARTFORD, N.Y. — The New Hartford Police Department is investigating a hit-and-run crash on June 25 that seriously injured a pedestrian.

Officers responded around 9:20 p.m. to the New Hartford Presbyterian Church parking lot on Park Street. Barbara Wuest, 82, of Utica, was in the lot when a vehicle hit her and fled the scene without stopping.

Paramedics airlifted Wuest to Upstate University Hospital in Syracuse with serious lower-body injuries. They said her injuries are not life-threatening at this time.

New Hartford police have not released a description of the suspect vehicle.

The New Hartford Fire Department assisted at the scene while detectives reviewed security footage and collected evidence.

Investigators ask anyone with information to call the New Hartford Police Department at 315-724-7111.

FATAL ACCIDENT INVESTIGATION

New York State sees approximately 15,450 pedestrian accidents annually, resulting in nearly 15,000 injuries and 283 deaths statewide. The state averages 312 pedestrian fatalities per year, with a rate of 1.6 deaths per 100,000 residents. About 15,000 pedestrians are injured annually, with 20% requiring hospitalization.

Nationally, over 20% of pedestrians killed in traffic accidents are struck by hit-and-run drivers, indicating this is a significant component of pedestrian fatalities. New York ranks fourth nationally for the highest percentage of pedestrian deaths in motor vehicle accidents.

Recognizing the severity of hit-and-run incidents, Governor Hochul recently signed legislation increasing penalties for drivers who flee crash scenes, raising fines up to $3,000. The state has also given municipalities authority to reduce speed limits to 25 mph to improve pedestrian safety.

Despite these efforts, traffic fatalities increased 18.4% in the first half of 2021 compared to 2020, highlighting the ongoing challenge of protecting pedestrians on New York’s roads.RetryClaude can make mistakes.

Candice Bond, an experienced hit-and-run accident attorney, said in such cases is imperative to have an independent investigation conducted by a seasoned attorney promptly to protect the rights of a victim.

“Having the proper resources is extremely important to investigate a hit-and-run accident case and prove negligence,” said Bond, a Managing Partner of Bond Legal.

“Road conditions, visibility, and lighting are all possible contributing factors considered and examined,” said Bond.

These procedures are necessary for helping someone who has lost a loved one at the hands of a hit-and-run driver receive the justice and monetary compensation they deserve.

WRONGFUL DEATH CLAIM

Pending the investigation, the family of Barbara Wuest may be entitled to a wrongful death claim for funeral expenses, the loss of love and companionship, pain and suffering, and emotional trauma.

“An incident is considered a wrongful death when either a person or entity commits a wrongful or negligent act resulting in death,” said Bond. “When vehicle accident fatalities result from unsafe driving, aggressive or distracted driving, speeding, or driving under the influence, family members are usually left with the option to pursue a civil action against the responsible motorist.”
